Bend asphalt sealing company appeals DEQ fine

The Oregon Department of Environmental Quality said Tuesday it has penalized Toploc Asphalt Maintenance LLC $2,375 for discharging wastewater containing petroleum products and other hazardous substances into its drywell, located at 821 NE Second Street in Bend.

The company does business as Central Oregon Asphalt Sealing.

Last September, DEQ officials said, the company disposed of industrial wastewater from its asphalt sealing operation into a drain, which conveys water to a drywell. A drywell, also called an underground injection system, collects runoff and allows the water to naturally drain into groundwater.

DEQ issued the penalty because discharging industrial wastewater to a drywell can contaminate soil and groundwater. Asphalt-based sealant contains hazardous substances and toxics, including petroleum products, and it is prohibited to dispose of these materials in a drywell.
