Oregon joins other states in Sirius XM settlement
Oregon Attorney General Ellen Rosenblum and 44 other state attorneys general announced Thursday a $3.8 million settlement with Sirius XM Radio Inc. resolving claims alleging that the satellite radio company engaged in misleading advertising and billing practices.
Sirius XM also will provide restitution to eligible consumers who have complaints about the problems addressed in the settlement, including complaints that consumers were wrongfully billed for SiriusXM services between July 28, 2008 and December 4, 2014.
“Any Oregonian who thinks they were wrongfully billed for SiriusXM Radio should submit a claim with the Oregon Attorney General’s office as soon as possible,” said Rosenblum. “While some consumers have already submitted claims with my office, there may be many more Oregonians who are eligible for money back.”
The multi-state investigation focused on consumer complaints involving: difficulty canceling contracts; cancellation requests that were not honored; misrepresentations that the consumer’s Sirius XM service would be canceled and not renewed; contracts that were automatically renewed without consumers’ notice or consent; unauthorized fees; higher, unanticipated rates after a low introductory rate; and Sirius XM failing to provide timely refunds.
Oregon consumers who have not previously filed a complaint with the Oregon Attorney General’s office for the alleged misleading billing practices covered by this settlement have 150 days to file a complaint to be considered for restitution.
Consumers can file a consumer complaint online with the Oregon Consumer Hotline or call toll-free 1-877-877-9392.
To be considered for restitution under this settlement, consumers must file a complaint concerning conduct from July 28, 2008, to Dec. 4, 2014, involving an identifiable loss that has not been previously resolved. Oregon consumers who have complained previously to Sirius XM directly, and believe that their complaint remains unresolved, can file also complaints on Sirius XM’s website.
