Pair held in Bend assault on good Samaritan aiding disabled person

Two Bend men have been arrested on assault and other charges, accused of attacking and using a stun gun on a good Samaritan who had come to the aid of a person with a disability on the Fourth of July,

Deschutes County District Attorney John Hummel said he filed charges Wednesday against Stephen Davies and Spencer Perez, both 24, on charges of third-degree assault, second-degree attempted assault and unlawful use of a stun gun.

On the night of the Fourth, Hummel said, Brandon Deluca and his neighbors and family were outside watching fireworks on Northeast Kearney Avenue.

Deluca said he saw a car almost strike one of his neighbors who has a disability. Two people then got out of the car and verbally insulted and harassed the person who was almost struck.

Deluca approached his neighbor to assist him, the DA said, “at which point the two passengers violently assaulted him, punching him repeatedly and shocking him twice with a stun gun.” The alleged assailants then fled.

Bend police found and arrested the two suspects on Tuesday.

“All criminal assaults are wrong and warrant punishment,” Hummel said in a news release. “But not all assaults are equal. If the state proves these suspects assaulted Mr. Deluca because he intervened to aid a person with a disability, we will ask the court to impose a punishment appropriate for such a heartless and cowardly act.”

The case will be presented this week to a Deschutes County grand jury for consideration of formal charges.

Perez also was being held without bail on a parole violation and on a first-degree harassment charge, while Davis was held without bail on parole and probation violations, according to jail records.

Perez is scheduled to be in court on Thursday at 1:30 p.m. and Davies next Wednesday at 1:30 p.m.
