Prosecutors clear police in fatal Klamath County shooting

KLAMATH FALLS, Ore. (AP) – The Oregon Department of Justice has determined that criminal prosecution is not warranted in the deadly shooting by police during a traffic stop on Highway 97 near Modoc Point last month.

The Herald and News reports Klamath County District Attorney Eve Costello had asked the state to review the shooting investigation, saying Monday there is no cause to prosecute.

Phillip Moskios Jr. was shot following a confrontation with law enforcement officers during a traffic stop just off of Highway 97 in southern Oregon in early October.

Authorities say Moskios assaulted an Oregon State Police officer after a K-9 alerted officers to his car.

Authorities say the Klamath Falls Police Department and the federal Drug Enforcement Administration were involved in pursuing Moskios.
