Bend man pleads not guilty to murder in fatal May attack on homeless man; trial date awaits OSP toxicology results
BEND, Ore. (KTVZ) – A 31-year-old Bend man, Brian Lee Wynn, pleaded not guilty Monday to second-degree murder in the late-May killing of another homeless man, David Carroll Hickman, 62,
Hickman’s body was at his campsite behind a gas station on North Highway 97 after a fatal attack that included stab wounds.
Defense attorney Sarah Yates entered a not guilty plea on Wynn’s behalf before Deschutes County Circuit Judge Alycia Sykora.
District Attorney Steve Gunnels said the prosecution is seeking a two-week (eight-day) trial.
But the setting of a trial date for Wynn was delayed, as the DA’s office is still waiting for toxicology results from the OSP Crime Lab, which would then be shared with the defense. He said they were told initially by OSP they would take six to eight weeks to complete.
“We’re past six weeks, so I believe we should be getting results within the next two weeks,” Gunnels said, suggesting they hold another hearing for the status of trial dates.
Sykora set that hearing for Sept. 4.
