Bend man arrested in Bi-Mart break-in, drugs theft
A 20-year-old Bend man who pleaded guilty in a string of marijuana dispensary break-ins last year was caught with a K-9’s assisting bite and arrested early Saturday after he broke into the Bi-Mart store with a rock and tried to leave with a backpack full of prescription drugs, police said.
Officers were dispatched to the store on Northeast Second Street around 2 a.m. after a burglar alarm sounded, Sgt. Tim Guest said. They arrived to find the glass broken out of the front door.
Soon after their arrival, police caught Daniel Joseph Shumny coming out of the store, holding a backpack full of medications stolen from the store’s pharmacy, Guest said.
Shumny did not comply with officers’ commands and was taken into custody by K-9 Kim and partner Officer Kevin Uballez, assisted by other officers, the sergeant said.
Shumny was taken to the Deschutes County Jail and booked on charges of second-degree burglary, first-degree criminal mischief and first-degree theft. He also was held without bail on a probation violation.
Shumny was arrested in June of last year on attempted burglary and criminal mischief charges, accused of using a large metal pipe to break the window of The Herb Center marijuana dispensary on Northeast Division Street. Police said at the time he was unable to gain entry to the dispensary.
Court records show Shumny was indicted last July on 11 counts including theft, burglary and criminal mischief. Hr was also accused in a July 2017 break-in at the Diamond Tree dispensary on Northwest Galveston Avenue, stealing more than $1,000 worth of items, as well as an August 2017 burglary of The Herb Center and a May 2018 break-in at Diamond Tree.
Shumny, who court records show had no prior criminal history, pleaded guilty last November to four of the burglary and theft charges. He was sentenced in early January to a day in jail (time served) and 18 months probation, including a substance abuse evaluation and conditions of no drugs or drug paraphernalia, as well as random drug testing and mental health evaluation and treatment.
