Albany man accused in 2008 rape case

ALBANY, Ore. (AP) – An Albany man has been accused of raping a woman at a park nearly 10 years ago.

The Albany Democrat-Herald reports (https://is.gd/bQkX1T ) 30-year-old John Benson questioned the statute of limitations at Monday’s arraignment and told the judge: “I shouldn’t even be here for this.”

Prosecutor Keith Stein said Benson knew the victim and forced himself on her after they had been drinking and smoking marijuana at a Lebanon park in 2008.

The Albany resident faces charges of rape, sex abuse and attempted sex abuse.

The prosecutor asked for $300,000 bail. The judge granted the request

Benson has prior convictions for attempted sodomy and attempted sex abuse.
